Terms of Service
Short version: HaulHard is a tool to help you do your job. We don’t certify your hours to the FMCSA — that’s your existing ELD’s job. We don’t guarantee that every parking spot we show is open, that every bridge clearance is current, or that the app won’t crash. You’re still the driver; the app is an assistant, not a substitute for judgment. The full text is below.
1. The agreement
These Terms of Service form a binding agreement between you and Sand Point Studios LLC ("HaulHard," "we," "us") governing your use of the HaulHard mobile app and the haulhard.com website. By creating an account, you accept these terms. If you don’t accept them, don’t use the app.
2. Eligibility
You must be at least 18 years old and legally permitted to drive a commercial motor vehicle in the jurisdiction(s) where you operate. We don’t verify your CDL, your medical card, or your endorsements; you represent that they’re valid by using the app.
3. What HaulHard is
HaulHard is a driver-side assistant application. v1 features include: parking and fuel discovery, NBI bridge-clearance overlay, manual hours-of-service log + countdown, trip log, voice command shortcuts, and (optionally) read-only integration with fleet ELDs that you separately subscribe to.
4. What HaulHard is not
- Not a fleet management platform. We have no dispatcher dashboard, no carrier-side admin, no manager console.
- Not an FMCSA-registered ELD. The hours-of-service countdown in the app is for your situational awareness only. Federal compliance with the ELD Mandate (49 CFR Part 395, Subpart B) requires an ELD certified to FMCSA Appendix A; HaulHard is not such a device. Your ELD-of-record remains whatever your carrier issued you (or your own self-certified ELD if you operate one).
- Not a load board. We don’t connect you to brokers or shippers.
- Not a replacement for your own judgment about parking, fuel, routing, or safety.
5. Bridge clearance, parking availability, fuel pricing — honest disclaimers
The bridge-clearance overlay is built from the FHWA National Bridge Inventory, an annual public dataset. NBI data is current as of the most recent annual reload but reflects the last inspection of each bridge, which may be months or years old. State DOT and local-road bridges are sometimes missing, miscoded, or out of date. Always verify clearance signage in person before passing under any structure. If our overlay says a bridge is clear and the posted height tells you otherwise, the posted sign wins.
Parking availability shown in the app combines vendor APIs (where available) and crowdsourced reports from other drivers. Reports are time-decayed and geofenced, but they reflect what other drivers said, not what’s currently true. A spot we show as "available" may be full when you arrive; a "full" report may be stale by the time you read it. Plan accordingly.
Fuel prices and discounts are from cached vendor data. Prices change between cache refreshes. The price you pay at the pump is the price the pump charges, not the price the app showed.
6. Voice commands
The voice command feature parses your typed or spoken transcripts using a deterministic intent parser. It refuses to dispatch when confidence is below a threshold rather than guess. Voice features are an aid; do not rely on the voice mic to take any safety-critical action. If the app misunderstands you and you don’t notice, you remain responsible for whatever you do or don’t do as a driver.
7. Account responsibilities
You’re responsible for keeping your account credentials secure. If your phone is lost or compromised, sign out of the account or contact us to revoke the session. We don’t recover lost passwords; the password reset is run by Supabase Auth and ties to your registered email.
8. Acceptable use
Don’t reverse-engineer the app for the purpose of building a competing product, don’t scrape our endpoints at volume, don’t submit knowingly false parking reports (other drivers rely on them), don’t use the API to harvest other drivers’ data. We may suspend accounts that violate these rules.
9. Beta software
v1 is beta. Things will break. Data may be lost in the rare case of a database recovery event. Backups are taken daily but they are not a guarantee. If continuity matters, export your trip log on a regular cadence (it’s a JSON download, see the Privacy Policy).
10. Pricing
The daily-driver tools (parking, fuel, voice, bridge clearance, manual HOS log, trip log) are free during the beta. A paid tier with permit scanning, AI route optimization, and additional features is planned for v2. We will notify users by email and in-app at least 30 days before any feature you currently use moves behind a paywall.
11. Intellectual property
HaulHard’s code, brand, marks, and content are owned by Sand Point Studios LLC. Your trip log, fuel records, parking reports, voice transcripts (if opted in) belong to you. Aggregated, de-identified data derived from your reports (e.g. "Loves stop #421 is averaging 30% utilization at 9pm") may be used to operate the app and benefit other drivers.
12. Disclaimers
HaulHard is provided "as is." We disclaim all warranties to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the app will be available without interruption, that data shown is accurate, or that defects will be corrected.
13. Limitation of liability
To the maximum extent permitted by law, Sand Point Studios LLC and its principals will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, business interruption, or accident-related claims. Our aggregate liability for direct damages will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) one hundred dollars (US$100).
Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the maximum extent permitted.
14. Indemnification
You agree to indemnify and hold harmless Sand Point Studios LLC against any third-party claims arising from your use of the app in violation of these terms or in violation of applicable law.
15. Termination
You can terminate by deleting your account (email feedback@haulhard.com with "delete" in the subject). We can terminate for material breach of these terms with reasonable notice. Termination ends our license to your data and triggers the deletion timeline in the Privacy Policy.
16. Governing law
These terms are governed by the laws of the State of Montana, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Gallatin County, Montana.
17. Changes
If we change these terms, we’ll update the "Effective" date and notify registered users by email about substantive changes. Continued use after the effective date of an update means you accept the change.
